By accessing or using Affai's services, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services. We may update these terms from time to time, and your continued use constitutes acceptance of any changes.
2. Description of Services
Affai provides an AI-powered platform for affiliate marketers to generate content, analyze data, and optimize their marketing campaigns. Our services include access to various AI models, content generation tools, analytics features, and API access based on your subscription plan.
3. Account Registration
To use our services, you must create an account with accurate and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use.
4. Acceptable Use Policy
You agree to use our services only for lawful purposes and in accordance with these Terms. Prohibited uses include: generating harmful, offensive, or misleading content; attempting to reverse engineer our systems; using our services for spam or fraud; violating any applicable laws or regulations; or interfering with other users' access to our services.
5. Payment and Billing
Subscription fees are billed in advance on a monthly or annual basis. All fees are non-refundable except as required by law. We reserve the right to change our pricing with 30 days' notice. If payment fails, we may suspend or terminate your access to the services.
6. Credits and Usage Limits
Your subscription includes a monthly allocation of credits. Credits do not roll over to the next billing period. Additional credits may be purchased separately. We reserve the right to impose reasonable usage limits to ensure service quality for all users.
7. Intellectual Property
You retain ownership of content you create using our services. However, you grant us a license to use your content to provide and improve our services. Our platform, including all software, designs, and documentation, remains our exclusive property.
8. Privacy and Data Protection
Your use of our services is also governed by our Privacy Policy. We are committed to protecting your personal information and using it only as described in our Privacy Policy.
9. Disclaimers and Limitations
Our services are provided "as is" without warranties of any kind. We do not guarantee that our services will be uninterrupted, error-free, or meet your specific requirements. Our total liability for any claims shall not exceed the amount you paid us in the 12 months preceding the claim.
10. Indemnification
You agree to indemnify and hold Affai harmless from any claims, damages, or expenses arising from your use of our services, violation of these Terms, or infringement of any third-party rights.
11. Termination
Either party may terminate this agreement at any time. Upon termination, your access to our services will cease, and you must stop using any content or materials obtained through our services. Provisions that should survive termination will remain in effect.
12. Governing Law
These Terms are governed by the laws of California, United States, without regard to conflict of law principles. Any disputes shall be resolved in the courts of San Francisco County, California.
